| Kentucky Workers Compensation Accident InjuryAfter the accident claim is filed the workers compensation claim is assigned to an ALJ and the employer and his insurance carrier is notified that the injury claim is filed. The carrier is required to deny or accept the accident claim and file a notice of injury claim denial or acceptance. Within 90 days after the case is assigned to the ALJ you are required to file your medical reports and any deposition to support your injury case. There is a very strict filing deadline miss it and you lose you workers compensation case. The accident case is then assigned to a hearing date and the ALJ must file his decision within 60 days after the hearing. Within 10 days after filing the employer must designate a treating physician for you on accident form 113. You fill the form out and the employer then send you a medical card you present to the physician. You have a one Time right to change this physician to a physician of your choice. Attorney Fees in Kentucky are limited to a 20% recovery contingent on winning your injury case. Lawyer fees cannot exceed 12,000 dollars.
