Kentucky Workers Compensation Disability Accidents

Workers Compensation is a compromise between Workers and Employers.  Long ago when workers were injured on the job they had to show that it was the fault of the negligence of the employer to get disability compensation.  Because accident litigation was long and attorney costs were so high few employees would win but when they did win employers lost large amounts.  As a compromise employees don't have to show that it was the employers fault in workers compensation cases and employees injured in the course of employment are allowed benefits. You only need to prove that you as an employee were injured on the job in the course of his employment to qualify for accident disability benefits.  

  1. Only Employees are covered.  If your employer controls how you do your work you are an employee not a subcontractor.
  2. Accident Disability on the job can mean going to and from work if going to or from benefits the employer such as taking the company vehicle home for a delivery on the way to work next morning.
  3. Workers Compensation in the course of employment means that you were doing the normal activity that would be done by an employee when you were injured.  If you criminally rob a 7/11 while you are on company time and are shot it does not qualify you for workers compensation because the disability didn't occur in the "course of employment".   However a baseball accident at the company picnic is covered because it is a normal company and employee activity even though it is off the clock.
