Kentucky Workman's Compensation Disability Benefits

In order to calculate benefits a person must take into consideration his average weekly wage and the formula for calculation of benefits.  You will need to know both the states average weekly wage and the Workmans average weekly wage.  Your "average weekly wage also includes some benefits that may be paid to you in addition to your  pay such as free rent meals or cars.  Your average weekly wage is fixed as the last date of your injury.   However how it is calculated may depend on other jobs you have worked at and your length of employment.  The average state wage is at 342.740(1).  

Permanent Total Disability is called PTD.  Temporary Total Disability is TTD.  Permanent Partial Disabilty is called PPD.  Temporary Partial Disabilty is TPD.    Total disability is paid 66% of his wages but not to exceed 100% of the State average.   Partial Disability is paid 66% but not to exceed 75% of the average state wage times the percentage of disability for not to exceed 425 weeks. Occupational Diseases are paid at a minimum of 66% of the averate wage not to exceed 75% for no more than 208 weeks at the highes level the person is paid 66% not to exceed 100% for the full term of the illness 342.730. 

Prior injuries can lower the amount to be received but the amount can be paid in a lump sum where the amount is reduced to it's present value.  100.000 paid to a person over 100 months at 1000 dollars a month is worth far less than 70,000 in cash paid to a person today.  Reducing a stream of payments over a long period of time to what it is worth as a lump sum is called reducing an amount to it's present value.  In order to finalize a case an insurance company will often offer to reduce a claim to a present value and to make a lump sum payment.  342.150.  

Should a person die he is allowed death benefits 342.720 and income benefits to his dependants 342.075 and 342.750
