Will Probate is a process.  As soon as a person dies someone the Executors are required to pay the debts that remain.  After the debts are paid the Executors must distribute the assets that are left over to the heirs.  All of this can be a simple process for the Executor or it can be a nightmare.  There are simple forms for the Executors in our manual that can streamline this into a simple process  if you are the Executor for a will in Kentucky.  An Executor  works with the attorney to gather the assets and to pay the debts of the estate.  If the attorney for the estate had to do everything while he charged 200 or 300 an hour there would be little left of some estates.  It is far better for a family member to be the Executor or personal representative and do the everyday tasks of handling the burial to limit  the attorney's work to filing the tax returns, the accounting and the court documents. 

     When do you use a will and when do you use a trust?  Generally when the person wants to give property away after death you use a will.  When you wish to give the property away while you are still alive and you still want control of the property you use a Trust.  There are strong tax and other reasons to dispose of the property before your death.  Using a trust  may allow you to protect the property from your creditors and insure that it goes to who you want it to.  Often in the final stages of an illness people may run up huge medical bills or by going into a nursing home Social Security may take their homes for the bills that an extended nursing home stay can run up.  If the person leaves property in a will the property is left to the heirs only after Social Security is paid back.  

      Why should anyone lose assets to Taxes Social Security and the Courts. Your inheritance was meant to go to your spouse and your children however the Courts often take property from the estate and give it to the wrong individuals or they take it for expenses.  A little bit of planning can keep you from losing everything and insure the safety of your spouse and children.
