In order to collect for a large Truck-Auto crash your attorney may have to prove that the truck driver violated safety rules such as 49 CFR 383.1(a). which applies "to every person who operates a commercial motor vehicle in interstate, foreign, or intrastate commerce, and to all employers of such persons." 49 CFR 383.3.

  • 387 Minimum Levels of Insurance Coverage: $500,000 Per carrier operating in interstate commerce; and, $1,000,000 per carrier if the truck carrier transports hazardous cargo in interstate commerce.

  • 390 Trucking company minimum requirements

  • 391 Minimum Physical qualifications of truck drivers

  • 392 Standards for operating commercial trucks

  • 393 Truck options necessary for safe truck operation

  • 395 Truck Driver’s operating hours (on-duty, off-duty in sleeper berths)

  • 396 Required inspection, repair, and maintenance for commercial trucks

  • 397 Truck hazardous materials; Truck Driver & parking rules.

Most professional truck drivers do not follow these basic safety rules of the road but showing that they don't is important to your case.
