When do I want to use a lawyer and when should I do the insurance case myself. Often people want to do your own insurance case. If the auto accident case is small and involves primarily automobile property damage and the insurance company will settle reasonably with you there may be no need for a lawyer. You only want to do a case in small cases that primarily only involve automobile property loss. Lawyers normally charge 150 per hour or more therefore small auto accident claims are difficult to justify the time of some lawyers. If the auto accident case involves less than 3000 or so in property damages you may want to settle the case yourself. Lawyers should always be used as early as possible when it involves - serious long term accident injuries
- permanent disability or insurance benefits.
- Medical Malpractice
- Accident injuries due to products or toxic exposure
- Whenever Fault is an issue
- or when any insurance company refuses to reasonably pay
Factors that normally involve lawyers and that increase the insurance amounts that you will recover include - Lost income
- Proving pain and physical suffering from the auto accident that can be documented by use of medication length of illness seriousness etc
- Problems proving the cost or the existence of accident injuries or the cost of your future medical insurance care. Since broken bones are more easily proved than sprained muscles they are worth more and are less attacked.
- The time you take to recover and what it will take
- Permanent injury, disability or disfigurement
- Emotional and psychological damage that you can prove by psychiatric treatment
- Loss of family social and educational opportunities.
If you are handling your auto accident case by yourself you should remember that insurance adjusters only pay your claim fully if you give him or her documentation to prove the accident losses. If you fail to give them proof of your accident losses they can't pay the claim fully. The automobile accident insurance cases that you personally handle without a lawyer should therefore be limited to very small property loss cases.
